The world of advocacy is growing giving the role itself more recognition in the reform of the Mental Health Act ‘White paper’ (2021). There are four advocacy services in the UK created by law currently.

These are:

  • Independent Mental Health Advocacy (IMHA)
  • Independent Mental Capacity Advocacy (IMCA)
  • Independent Care Act Advocacy (ICAA)
  • Independent Complaints Advocacy Service (ICAS).

Independent Mental Health Advocacy

People experiencing mental ill health can be detained for treatment (sent to hospital even if they do not agree they need it) under the Mental Health Act 1983.

Independent Mental Health Advocates support people in that position to understand and exercise their legal rights.

 

Independent Mental Capacity Advocacy

The Mental Capacity Act 2005 covers the treatment of people who cannot make some important decisions for themselves.

Independent Mental Capacity Advocates (IMCAs) help to safeguard the rights of people in those circumstances.

An Independent Mental Capacity Advocate can help people 16 or over when a decision needs to be made about a long-term change in accommodation or serious medical treatment AND the person lacks capacity to make that decision, AND there is no one independent of services, such as a family member or friend, who is appropriate to consult about what the person would choose for themselves.

An IMCA may also be provided to people for other decisions concerning Care Reviews or Adult Protection.

In Adult Protection cases an IMCA may be instructed even where family members or others are available to be consulted.[/vc_column_text][/vc_column][/vc_row]
